To understand how do bail bonds work in the state of Washington, you need to know there are basically five ways to get released before the trial:
1. Cash bond – you post the entire bail amount up front.
2. Surety bond – you use a bail bondsman who posts the entire amount and charges you a fee for doing so.
3. Property bond – you post real estate for the bail amount. Not very common because of the time factor and some courts are not equipped to handle it.
4. Own recognizance (O.R.) – no bail or financial security required.
5. Citation release – basically just a notice that the defendant must appear at court hearings.
Bail bond agencies must be licensed in Washington. They must have a physical location within the state, have no criminal convictions in the last ten years, a valid business license, a license from the Office of the Insurance Commissioner, contracted with an approved surety company, and three years experience as a manager of a bail bonds business. We recommend you work with an agent that is a member of the Washington State Bail Agents Association (WSBAA). While this membership is not a state requirement, it does show a willingness to be part of an organization that self regulates ethics in this business.
In Washington, the bail fee is almost always 10% and is regulated by the Washington State Insurance Commissioner. So for a $40,000 bail, the bail bondsman will charge you $4,000. Certain federal and immigration cases may be as high as fifteen percent.
