For the most part there are only four ways to post bail in New Jersey.

1. Cash Bail: Pay the entire amount yourself in some form of cash, money order or electronic payment such as credit or debit card. You will get it back minus some fees after the trail has been completed. You will not have access to this money before then and if the defendant does not make all court appearances, you will forfeit the money.

2. Ten Percent (10%) Cash Bail: Not available in first or second degree cases. The defendant must complete a Bail Recognizance Form for the remaining 90%. Generally this is only available in minor offenses and may be much harder to get in some parts of New Jersey over other parts.

3. Real Estate or Property: While many websites claim that all courts in NJ allow the defendant to post real estate for bail, we have found that is not always the case. Also, the real estate must be located int he state of New Jersey.

4. Bail bonds: Use a third party bondsman to post the bail. The state of New Jersey sets the fee a bondsman can charge to 10%

Most bondsmen in the state are able to post bond anywhere in New Jersey. and they all have standard agreements with each local court to post irrevocable blanket bonds. That means they will pay the court if the defendant does not make all their required appearances. They usually have a credit arrangement that the court can draw from and this eliminates the need for a NJ bondsman to deposit cash or property with the court every time a new defendant is bailed out.

In New Jersey, unlike many other states, bail bondsmen must be registered by the insurance company for which they are authorized to write bail. The names of those who are authorized to write bail in New Jersey are listed in the Bail Registry. Generally speaking, you should not do business with any bondsman who is not in the Registry.

Some courts in New Jersey may require a Bail Source Inquiry Questionnaire (BSIQ) or a Bail Source Hearing. This is because they want the defendant to show that the money used for the bail bond is derived from legal means. While this is often required in drug cases, it can also be required in others as well. In federal courts this is called a Nebbia hearing. If this is required, you should be prepared to show paychecks, income statements, bank statements and other documents that will track the source of the money.
