In Massachusetts, after arrest, you will have the opportunity to have a Clerk Magistrate Hearing, or bail hearing. If the arrest is for a minor issue and a first offense, you may be released without any bail required. However, most cases will require bail to be released. It is important that you try to secure bail because otherwise you will have to remain in jail until the case has been tried and completed. In Massachusetts, this may take a while, perhaps months in some cases.
We have found that in most Massachusetts jurisdictions the district attorneys tend to be fair and not punitive in their arguments for bail. In some states, the D.A.s will often go for the jugular at the bail hearing, but not so in MA.
As soon as the defendant is booked, even before bail is set, the case information is entered in the local court computer records. Most bail bondsmen have access to these records so it is a good idea to start making bondsmen connections early on. They can look up the records and answer all your questions online including where the defendant is being held, how much has the bail been set at, what are the specific charges, etc.
