The most common type of bond in Colorado is a surety bond. You would use this if you need a bail bondsman to arrange bail for the defendant. By state law, a Colorado bail bondsman cannot charge more than 15% of the bail amount. So if bail is set at $10,000, the maximum amount the bondsman can charge you is $1,500. However, in Colorado, some bail bondsmen charge less. It is not uncommon to pay 10% or less. Other charges may include a booking or bond fee by the county court. This may range from $10 to $50. Generally, the Colorado bail bondsman should not charge any other fees. So in Colorado it pays to shop around for a bail bondsman. Email several and ask what their bail percentage fee is and if there are any other charges. You want to make sure that they are not quoting a low percentage fee but making it up in additional miscellaneous fees. By emailing, you will have their response in writing so there are no mis-understandings when you sign the contract.

Colorado does allow for payment plans and many Colorado bail agents offer them. So if you are unable to pay the 10-15%, this may be another option to ask about.

Typically the bondsman will require a co-signor or collateral as well. If you are investigating a bond for someone other than yourself, you should also ask if you can obtain a signture bond. A signature bond means you will not have to be a co-signor or put up collateral.

There are six other primary types of bonds available in Colorado.

Cash bond: The court requres the entire bail amount to be paid in cash. This usually only happens for serious charges or if the defendant has a history of missing court appearances.
Property bond: In general, we usually don’t recommend this unless there are few other choices. The property value must be in excess of the bail amount and is secured by offering the court a deed of trust. So in essence, the propery is held in mortgage by the county or state and can be lost or forfeited in its entirety if the defendant fails to appear. Depending on the court and because of its complications, the property bond is only available through certain officials on certain dates and times of the week.
Walk-Through Bond: Somewhat unique to Colorado, walk-through bonds allow the defendant to post a cash/surety/property bond by having a bondsman go to the authorities and arrange bail BEFORE the defendant is arrested. The court will assign an appearance date and the defendant will not have to spend time in jail before sentencing.
Citation/Cite-Out: Similar to a ticket. The defendant is asked to pay a fee. Upon paying it, there may be a further fine and there may not be a court date set depending on the charges.
Personal Recognizance (PR): The court releases the defendant on their promisre to appear in court. Usually only for minor offenses of if the defendant has an outtanding reputation in the community.
Pre-Trial Release: In addition to a set bail, the judge or court can require the defendant to report to the county’s Pre-Trial Services. Commonly, this is for defendants who have drug problems or other high risk issues. The defendent will have to check-in regularly and submit to ankle monitoring, drug testing, SCRAM (alcohol testing). To top it off, the defendant may also be asked to pay for all of this as well. Of course, ultimately, it is better than being in a Colorado jail or prison.
